Subtitles aren't in the DLNA specification.
I never did get embedded srt subtitles in mkv to work over dlna. But if i extract them from the mkv and give them the same filename it at least works with mezzmo's dlna server, but not fritzbox'.

Anyway don't use DLNA but hope for samygo for your tv: forum.samygo.tv/viewtopic.php?f=20&t=3266
Then you could use the virtual usb drive and access the smb share (in fritzbox: Speicher (NAS) aktiv) directly with the superior internal media player, which gives you working embedded subtitles and supports more formats (ts container).

What's the dlna server you are using?
Sure that it's not transcoding it and makes hardsubbed subtitles?
